These Terms and Conditions form a contract between Foxwood Property Company Ltd ("FPC", "we", "us") and you ("guest", "booker") for the short-term use of our serviced apartments (furnished holiday lets). By booking or staying, you agree to these terms. The booker is responsible for ensuring all party members are aware of and comply with these terms. FPC may decline bookings or refuse key handover if these terms are not met.

1. SCOPE

1.1 Your stay does not grant exclusive possession or create a landlord-tenant relationship with FPC. This is a short-term let, and you have no rights under tenancy laws, including the Rent Act 1977 or Housing Act 1988.

2. BOOKING

2.1 FPC reserves the right to refuse any booking at any time for any reason.

2.2 FPC will reserve your booking dates once payment has been taken; however, the booking is not fully completed until 2.3 is satisfied.

2.3 A booking is only confirmed when payment, photo ID of the booker, and the security deposit (if applicable) have been received, and we have sent confirmation.

2.4 No booking is made or contract concluded when payment is declined or unauthorised.

2.5 The booker must provide valid card details at booking via Stripe. You agree that FPC may charge this card for any applicable costs under these terms.

2.6 All guest names, including whether they are adults or minors, must be provided at the time of booking.

2.7 Bookings may only be made by a person aged 18 or above, and there must be at least one person aged 18 or above staying in the accommodation.

2.8 You may not re-sell or re-assign your booking to any other person or organisation without the express authority of FPC.

2.9 You may occupy the property only for the agreed hire period, with the named guests. You are responsible for the actions and omissions of any visitors.

2.10 Check your confirmation and invoice upon receipt and notify us immediately of any errors. We are not liable for unreported inaccuracies and may correct mistakes when identified.

2.11 Exceeding the occupancy limit breaches Health and Safety rules. We may charge for extra apartments or require excess guests to leave.

2.12 If you wish to extend your booking, please inform us as soon as possible; this may not always be possible.

3. PAYMENT

3.1 Payments may be made by credit card, debit card, cash or bank transfer.

3.2 By paying the booking fee or the booking deposit, you are agreeing to all the terms and conditions in this document.

3.3 The total price is shown before booking. Prices may change over time, but no extra charges or refunds apply after payment.

3.4 Unpaid amounts incur 4% annual interest above the Bank of England base rate, accruing daily until fully paid, whether before or after judgment.

4. PAYMENT AND BOOKING DEPOSIT

4.1 For bookings made through this website, the full booking fee is charged to the card you provide at the time of booking, and an invoice and receipt are emailed to you.

4.2 30% of the booking fee is a non-refundable booking deposit. The remaining 70% is refundable only in accordance with section 5.

4.3 For bookings arranged with us other than through this website, we may instead take the 30% booking deposit to secure your dates, with the balance due before arrival. The deposit is non-refundable in the same way.

5. CANCELLATIONS

5.1 The following cancellation provisions apply unless specified otherwise in the reservation information provided prior to booking.

5.2 "Standard Bookings" are bookings of 27 or fewer consecutive nights. "Long-Term Bookings" are bookings of 28 or more consecutive nights.

5.3 You may cancel a Standard Booking at any time up to 14 days prior to the first day of your booking and receive a refund of any amount paid, less the 30% booking deposit (see 4.2).

5.5 Cancellations made after the deadlines in 5.3 and 5.4 are not refundable. If you cancel, reduce the number of guests, or shorten your stay after the booking start date, no refund will be issued.

5.6 If we must cancel or change your booking, we will notify you as soon as possible. If no suitable alternative is available or acceptable, we will issue a full refund, including the booking deposit.

5.7 Depending on the reasons for your alteration, you may be able to reclaim cancellation charges from your travel insurance. We recommend that guests purchase adequate booking and travel insurance.

5.8 Non-arrivals will be treated as a cancellation, and you will not be entitled to any refund.

5.9 Transaction fees are not refundable in the event of a cancellation.

5.10 All cancellation policy times are based on the property's local time zone.

5.11 Refunds, if applicable, will be issued to the original payment method after keys and parking permits are returned and the property is inspected. Processing may take up to 10 business days.

5.12 As accommodation is provided for a specific date, the 14-day cancellation right under the Consumer Contracts Regulations 2013 does not apply (regulation 28(1)(h)).

6. PROPERTY INSPECTIONS, REPAIRS & CANCELLATIONS DUE TO DAMAGE

6.1 FPC may inspect properties at any time to ensure maintenance, cleanliness, compliance with house rules, or to complete services such as extra cleaning and linen changes.

6.2 FPC may access the property for emergency repairs, remedial work, or health and safety checks.

6.3 Where possible, we will provide advance notice before entering the apartment.

6.4 If an inspection finds a property abused, significantly damaged, or excessively unclean, FPC may cancel your booking immediately. Guests are fully liable for all damage, breakages, or extra cleaning required, with costs not limited to the security deposit amount. If damages are identified after checkout, we will notify the booker with a breakdown of costs, including photographic evidence where possible. Guests must indemnify FPC for all loss and damage caused by themselves or their visitors and pay any charges immediately upon demand.

7. SECURITY DEPOSIT & LIABILITY FOR DAMAGES

7.1 Before occupying the property, you must provide a security deposit to cover potential damages, losses, unpaid fees, or breaches of this agreement. The deposit amount will be confirmed at booking and must be provided before check-in. Failure to do so may result in cancellation of your booking.

7.2 For bookings made through this website, the card details you provide at checkout are held securely by Stripe and serve as your security deposit. You authorise FPC to charge this card in line with these terms, including for any additional services you request.

7.3 The security deposit covers, but is not limited to: damage beyond normal wear and tear; outstanding utility bills or service charges; unpaid rent or fees due; any breach of house rules; replacement of stolen or missing items; repairs or replacement of damaged furniture, appliances, or fixtures; and any other costs allowed under UK law or this agreement.

7.4 After your departure, FPC or its representative will inspect the property. If deductions are required, a detailed cost breakdown will be provided in writing.

7.5 If damages or unpaid fees exceed the deposit, you must pay the remaining balance within the timeframe of the invoice.

7.6 You authorise FPC to charge any outstanding costs using the payment details provided at booking.

8. HOUSE RULES & GUEST RESPONSIBILITIES

8.1 Guest Conduct – The booker is responsible for ensuring all guests and visitors comply with these terms. Both must respect other residents and communal areas, and avoid causing disturbance.

8.2 Occupancy & Use – No parties, events, stag or hen dos. The number of guests must not exceed bed capacity; violations may void insurance and cancel the booking. The property must not be used for illegal activities under UK law. No commercial filming, photography or business operations (remote work is allowed).

8.3 Noise & Disturbance – Keep noise levels reasonable, especially 11pm to 8am. Disturbing other residents or staff may result in eviction and cancellation of the booking.

8.4 Smoking, Vaping & Illegal Substances – Strictly no smoking or vaping indoors (£150 charge for cleaning and airing). Any damage or booking delays due to smoking will incur additional charges. Anyone using or under the influence of illegal drugs (Misuse of Drugs Act 1971) will be reported to the police and required to leave.

8.5 Check-in & Check-out – Check-in from 4pm; check-out by 10am. Late check-outs cost £50 per extra hour. Late check-out causing booking delays may result in extra fees or cancellation.

8.6 Property Care – Guests must report damage immediately. No charcoal BBQs, candles or open flames. Pets are not allowed unless agreed in writing (assistance dogs permitted). Waste must be disposed of in the designated communal bins (£40 charge per incorrectly disposed bag). All equipment must be used in accordance with its operating instructions and only for its intended purpose.

8.7 Property Access & Repairs – FPC may enter for repairs or inspections, with notice where possible; emergencies (e.g. leaks, safety risks) may require immediate access. Guests must not alter the property, move furniture or attempt repairs.

8.8 Parking – Use only the designated parking bay. Parking permits must be returned on departure (£40 charge for non-return). FPC is not liable for vehicle damage, loss or fines.

8.9 Safety & Security – No hazardous materials or equipment. Do not tamper with fire alarms, smoke detectors or emergency systems. Keep doors and windows secured when leaving. Radiators must not be used to dry clothing and must be turned off or set to the lowest setting when leaving the property. Guests with small children must provide their own childproofing equipment. Use the correct adaptor for non-UK electrical appliances; heated appliances must be switched off and stored safely before leaving.

8.10 Keys & Lockouts – Lost keys incur a £30 replacement fee; if locks require changing, guests must cover the cost. Lockouts between 9pm and 9am may incur a £50 call-out fee.

8.11 Humidity & Ventilation – Use extractor fans while cooking and showering. Use the dehumidifier when drying laundry. Open the windows for at least 10 minutes each day. Damage due to excess humidity is chargeable.

8.12 Condition on Departure – Leave the property in a similar condition to that found at check-in. Excessive mess requiring extra cleaning incurs a minimum £100 charge.

8.13 Emergency Call-Outs – Calls to staff between 9pm and 8am for non-emergencies may incur a £50 fee.

9. DAMAGE, THEFT & ADDITIONAL CHARGES

9.1 Guests must inspect the property and report any concerns within 3 hours of check-in. Failure to do so confirms acceptance of the property's condition.

9.2 Charges may be applied at check-out or later if required. If payment cannot be processed, an invoice will be issued, payable within 7 days.

9.3 A receipt detailing all charges will be provided.

9.4 If a guest disputes responsibility for damage, FPC's assessment will be final. Charges may include compensation for lost income if repairs make the property unavailable.

10. UTILITIES & SERVICE INTERRUPTIONS

10.1 Excessive use of gas, electricity or water may incur additional charges. Heating and hot water systems are pre-set for guest comfort; overriding these settings may result in extra costs and unsafe situations.

10.2 FPC is not responsible for interruptions to utilities (gas, electricity, water, internet) or disruptions caused by maintenance or repair work within the building or surrounding areas.

11. PRIVACY, DATA PROTECTION & PAYMENT SECURITY

11.1 FPC processes your personal data in accordance with our Privacy Notice. By booking, you confirm the accuracy of the details provided.

11.2 Payments are securely processed via Stripe (PCI-DSS compliant). FPC does not store your card details. See Stripe's privacy policy at stripe.com/gb/privacy.

12. JURISDICTION

12.1 This agreement is governed by English law, with disputes resolved in the courts of England and Wales.

13. ENQUIRIES

13.1 FPC will respond to all reasonable enquiries but is not liable for delays in response.

14. COMPLAINTS

14.1 Raise any concerns with FPC during your stay.

14.2 If unresolved, submit a formal complaint by email to foxwoodpropertycompany@gmail.com with full details.

14.3 FPC aims to respond within 3 working days but will notify you if a delay occurs.

14.4 We may reject complaints deemed vexatious or made in bad faith.

15. LOST PROPERTY

15.1 Lost property left after departure will be removed and stored by FPC for 14 days; unclaimed items may be disposed of at the guest's expense.

15.2 Guests must cover all postage and return costs to reclaim lost property.

15.3 Perishable, illegal or hazardous items will be disposed of immediately.

15.4 FPC is not responsible for lost, stolen or damaged personal items.

16. LIMITATION OF LIABILITY

16.1 FPC's liability is limited to the total booking cost, except in cases of negligence under the Hotel Proprietors Act 1956.

16.2 FPC is not liable for indirect or consequential losses (e.g. lost profits, reputational damage).

16.3 Guests should arrange travel insurance to cover personal belongings.

16.4 FPC is not responsible for damage caused by external factors outside our control (e.g. natural disasters, strikes, government actions, supplier failures).

16.5 FPC does not exclude liability for death, personal injury, fraud, or any matter that cannot be excluded under UK law.

16.6 Apartment descriptions and photos are for illustration only. While we strive for accuracy, we do not guarantee completeness.

17. SEVERABILITY

17.1 If any term is invalid or unenforceable, the rest of the agreement remains in effect.

18. ENTIRE AGREEMENT

18.1 This agreement constitutes the entire agreement between FPC and the guest, superseding all previous communications.

19. THIRD-PARTY RIGHTS

19.1 No third party gains rights under this agreement unless expressly stated.

20. ENFORCING THIS CONTRACT

20.1 If FPC does not immediately enforce a term, it does not waive the right to enforce it later.
